Neil Elan is an Associate in the Civil Litigation and Trust and Estate Litigation Departments of FMBK, LLP.

Neil’s civil litigation practice focuses on all areas of business and commercial litigation, with a particular emphasis on business dissolution, buy-sell agreements, prosecution and defense of breach of contract and promissory note actions, business torts, unfair business practices, fraud, and Anti-SLAPP.  In his civil litigation practice, Neil’s represents real estate developers, limited liability companies, closely-held corporations, financial institutions, entertainment producers, commercial landlords, and business owners.

Neil’s trust and estate practice involves all aspects of probate and trust litigation, including elder abuse, Heggstad petitions, petitions to invalidate estate plans, petitions for final distribution, court confirmation hearings, creditor’s claims, petitions for family allowances, and waiver of accounts. In the trust and litigation sphere, Neil represents individual, professional, institutional, and court-appointed fiduciaries in contested trust and estate proceedings.

On occasion, Neil also handles various civil and probate family-law cross-over matters, including those related to elder abuse and palimony actions, and has even co-authored articles on the issue.

Neil understands that each case is more than just a file–it is story with moving parts, complicated personalities, and rapid needs. Neil strives to protect the fast-moving, cutting-edge business and interest needs of his clients, and is committed to finding creative and effective solutions. Neil understands that litigation is not for the faint of heart, and prides himself in ensuring that the client’s legal—and often emotional—needs are well protected.

Neil was selected as a 2016 and 2017 Rising Star by Los Angeles Magazine, a recognition that no more than 2.5% of the lawyers in the state receive. Neil has also co-authored articles including “Claims of Undue Influence Are Considered under Different Standards in Family Law and Probate Matters” published in the Los Angeles County Bar Association Family Law Symposium for the years 2014, 2015, and 2016.
